1. About these terms
These terms are an agreement between you and Dead Quiet Studio Ltd (“Dead Quiet”, “we”, “us”), a company registered in England and Wales, whose registered office is Unit 18 Gateway, 1000 Whittle Way, Arlington Business Park, Stevenage, Hertfordshire, SG1 2FP, United Kingdom.
They govern your use of the DQ Master Rack application, our website at deadquiet.studio, and the mastering credits and subscriptions you buy from us. By creating an account, installing the app, or completing a purchase, you agree to these terms. If you do not agree to them, please do not use the app or buy a plan.
You can contact us any time at mgmt@deadquiet.studio.
These terms work alongside our Privacy Policy and our Refund and Returns Policy. Where the Refund Policy says something specific about refunds, that policy applies.
2. What the words mean
- The App — the DQ Master Rack software you download and run on your own Mac.
- A Master — the processed version of a track the App produces.
- An Export — saving a finished master out of the App to a file. One export uses one credit.
- A Credit — one export. Previewing and auditioning inside the App is free and never uses a credit.
- The DQ Signature — our mastering chain, profiles and processing “brain”. This is our intellectual property (see section 4).
- A Subscription — a monthly plan that gives you a set number of credits each month.
3. Your account
To use the App you need an account. You agree to give accurate details, to keep your login and licence key secure, and to be responsible for what happens under your account. Your licence key is personal to you — sharing, reselling or publishing it ends your licence with no refund, as set out in the Refund Policy. If you think your key has been compromised, email us and we will reissue it.
You must be at least 18, or old enough to enter a contract where you live, to buy from us.
4. The DQ Master Rack licence
When you hold a valid licence, we grant you a personal, non-exclusive, non-transferable licence to install and use the App to master your own audio, for as long as your licence is active.
You may not: copy, resell, rent or redistribute the App; reverse-engineer, decompile or attempt to extract the DQ Signature, the mastering engine or any profiles or models; remove or alter our branding; or use the App to build a competing product.
The App, the mastering engine, the DQ Signature and all profiles remain our intellectual property at all times. Nothing in these terms transfers any ownership of the software or the DQ Signature to you. Some of these components are fetched to your machine only while you are using a licensed session, and remain ours.
5. Your audio and your masters
Your music stays yours. You keep all rights to the audio you load into the App and to the masters you create with it. We claim no ownership of, and no licence to, your recordings or your finished masters.
The App renders on your own machine — your audio is not uploaded to us or to anyone else to be processed, and we do not store your audio or your finished masters. (See the Privacy Policy for what the website and your account do collect.)
You are responsible for keeping your own backups of your audio and your exported masters.
6. Credits — how they work
- One credit = one export. Loading a track, mastering it and listening back is free. A credit is only used when you export a finished file.
- Exporting a revision uses another credit. So it’s worth auditioning until you’re happy before you export — that part costs nothing.
- Single credits can be bought one at a time, with no subscription, and do not expire.
- Subscription credits are included with a monthly plan, described below.
7. Subscriptions, renewal and payment
We currently offer monthly plans of 10 masters at £24.99, 25 masters at £39.99, and 50 masters at £49.99 per month. Prices are in GBP and include VAT where applicable.
- Your monthly credits reset each month and do not roll over. The credits included with your plan are for that billing month only; any you don’t use are not carried into the next month.
- Your month runs from the day you subscribed (and renews on that same date each month), not from the calendar 1st.
- Your subscription renews automatically at the plan price each month until you cancel. Payment is taken through our processor, Stripe; your card details are entered directly with Stripe and are never stored or seen by us.
- You can cancel any time in My Account. When you cancel, your plan stays active until the end of the month you’ve already paid for, and does not renew after that.
- Price changes. If we change a plan’s price, we’ll tell you by email before it takes effect, and you’re free to cancel before the new price applies.
8. Upgrading and downgrading
- Upgrading takes effect immediately. You pay the difference between your current plan and the new one at the point you upgrade, and the higher credit allowance is available straight away.
- Downgrading takes effect at your next renewal, so you keep the plan you’ve paid for until then.
9. Cancelling, and your right to cancel
Because credits and app access are digital content supplied immediately, a specific consumer rule applies. Under the Consumer Contracts Regulations 2013 (and equivalent EU law) you normally have 14 days to cancel an online purchase. For digital content delivered straight away, that right ends once supply begins, provided you have agreed to it and acknowledged that you lose the right to cancel.
At checkout you confirm two things: that you accept these terms, and that you want your credits (and app access) made available immediately and understand that doing so ends your 14-day right to cancel. If you would rather keep that right, don’t complete the purchase — email us and we’ll arrange the order manually.
Refunds are governed by our Refund and Returns Policy. In short, once credits or a licence key have been made available we don’t refund for change of mind, but we will always put right genuine faults, double charges, or anything not as described.
10. Acceptable use
You agree to use the App and our services lawfully, and you confirm that you hold the rights to any audio you master and export with the App. You must not use our services to infringe anyone else’s rights, to process unlawful content, or to resell mastering as a pass-through of our service without a licence to do so. Mastering client work — for example as an engineer working on behalf of an artist — is fine.
11. Availability, updates and support
We work hard to keep the App and the service running, but we provide them “as is” and can’t promise they’ll always be available or entirely free of faults. We may update or improve the App, and occasionally there may be downtime for maintenance or reasons beyond our control. Support is by email at mgmt@deadquiet.studio, and supported systems are listed on the product page.
12. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited under law.
Subject to that, we are not liable for loss of profits, loss of business, or loss of data or audio that you haven’t backed up, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. The App is a tool to help you master your own work; you remain responsible for checking your masters before you release them.
13. Privacy
How we handle your personal information is set out in our Privacy Policy.
14. Changes to these terms
If we change these terms we’ll update this page and change the date at the top. If a change materially affects a subscription you already hold, we’ll tell you by email.
15. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. If you’re a consumer living elsewhere in the UK or the EU, you keep the benefit of any mandatory consumer protections of the country you live in.
